Actress Halle Berry and the father of her daughter, Gabriel Aubry, have come to some agreement in family court Thursday. Last week, a brawl in the driveway between Berry’s fiancé, Olivier Martinez, and Aubry landed the child’s father in jail. Though Aubry and Berry have come to some sort of an ‘amicable’ deal, Martinez and Aubry have taken legal actions against each other.
In a printed statement shown to reporters by Berry’s attorney, Blair Berk, it says, “From all counsel, the parties have reached an amicable agreement. There will be no further statements regarding this matter.” The agreement was reached during a private session at a Los Angeles County courthouse. In attendance was Berk, without Berry present, Aubry and his lawyer, Shawn Holley. Unfortunately, both lawyers would not discuss what the agreement covers.
With one legal battle seemingly being settled, all that remains are the legal actions Aubry and Martinez have taken out on each other over their scuffle that occurred on Thanksgiving Day. As a result of the fight, Martinez had Aubry arrested and accused him of battery while Aubry filed a restraining order against Martinez, saying he was the one who initiated the fight. Also, Berry decided to secure an order that prohibits Aubry from having contact with her as well as their 4-year-old daughter, Nahla.
After their five-year romance ended in 2010, Berry and Aubry have been engaged in a bitter legal fight over custody of their 4-year-old daughter. Last year, their battle heated up after Berry announced her engagement to Martinez. She had asked the family court to grant her permission to move to Paris with her daughter.
According to a sworn statement made by Aubry that helped in acquiring a temporary restraining order against Martinez, he said the fight was influenced over the custody battle, in which the family court denied her request. Under the shared custody agreement, Berry does pay Aubry child support but was also told that the only way she can move to Paris is that Aubry does so as well.
In Aubry’s statement, he said, “While he was attacking me physically, Mr. Martinez said to me in an aggressive and threatening voice, ‘You cost us $3 million. When you see the judge, you’re going to tell him you’re going to Paris or I’m going to kill you. You’re going to Paris, you’re going to get your 20 grand a month in child support. From now on you’re going to do drop-offs on the street.'”
Aubry’s lawyer also shared with the court photos that showed his swollen, blackened eyes, cut lip and bruised face. The filing also said that he was treated at Cedars-Sinai Medical Center to repair three cuts in his mouth, a fractured rib and several bruises on his forehead and face.
